Define the Role of the Expert Witness

 

Start by defining the expert's role in your case. Do you need them for technical analysis, expert testimony, or consultation? The expert’s expertise should align closely with the case’s subject matter and your overall legal strategy.

 

Evaluate Qualifications and Experience


While credentials are important, practical experience can be just as valuable. Look for experts with relevant industry or field experience—whether a med-legal expert, orthopedic expert, litigation expert or other type of expert witness. Additionally, consider whether they’ve published on the subject, participated in prior litigation, or demonstrated authority in their field.

 

Assess Communication Skills


An expert witness needs to communicate complex topics in simple, understandable terms. They should be able to explain their findings clearly to judges and juries who may not have technical expertise. Mock examinations can help evaluate an expert's ability to testify under pressure.

 

Ensure Impartiality


The expert’s credibility depends on their impartiality. Make sure there are no conflicts of interest and it is preferable to choose an expert that is not frequently testifying just for one side.  A neutral expert witness with a balanced record is more likely to withstand scrutiny.
